Automobile Accidents

• 35-year-old married male was a driver involved in an intersectional accident with defendant. Defendant alleged that plaintiff ran through a stop sign. Plaintiff sustained multiple injuries including herniated discs, nerve damage requiring surgery. Because of said injuries, plaintiff was disabled. No offer was initially made then an offer of $5,000 was rejected.

The Result: Jury verdict in favor of plaintiff and against defendant in the amount of $2,700,000.00.

• 36-year-old male chef was a passenger in rear cargo area of Defendant's truck. While plaintiff was attempting to exit the vehicle, defendant negligently moved the truck causing plaintiff to slip and fall backwards out of the truck. Plaintiff sustained multiple injuries including a basal skull fracture, concussion, and loss of sense of smell. An offer of $125,000 was rejected during trial.

The Result: Jury verdict in favor of plaintiff against defendant in the amount of $975,000.00.

• 24-year-old male, who was traveling with his girlfriend, was involved in tractor-trailer vs. car accident. Tractor-trailer rear-ended plaintiff's vehicle causing a head injury, nerve damage and permanent facial scarring requiring surgery.

The Result: Case settled after for $950,000.00 after jury was selected.

• 40-year-old female with limited tort insurance was involved in car accident. Plaintiff was on disability before accident but aggravated injuries in accident. Plaintiff claimed nerve injury from accident. No offer was ever made to plaintiff.

The Result: Jury verdict in favor of plaintiff in the amount of $900,000.00.

• 25-year-old female was a passenger in a vehicle involved in a head-on collision involving multiple injured parties. Plaintiff sued both drivers as well as the bar where one of the driver's became intoxicated. Plaintiff suffered permanent injuries including a fractured leg requiring surgery.

The Result: plaintiff's case settled for $374,500.00 out of a $907,000.00 policy that was split up among multiple plaintiffs.

• 31-year-old male and 23 year old female involved in a motor vehicle accident with defendant. Female sustained multiple injuries including a herniated disc and nerve damage. Male sustained multiple injuries including disc bulges and nerve damage. The Result: Female's claim settled at time of trial for defendant's policy limits of $100,000.00. A $12,000 offer for male's claim was rejected.

The Result: Jury verdict in favor of male plaintiff against defendant in the amount of $350,000.00.

• 34-year-old male with limited tort insurance involved in a motor vehicle accident on interstate with defendant. At the time of the accident, plaintiff was already out of work from a previous work injury. However, as a result of the accident, plaintiff sustained injuries including a concussion, a disc herniation and missed time from work.

The Result: the case was settled for $300,000.00.

• 42-year-old male was operating a tractor-trailer that was hit in the rear by the defendant's vehicle. Plaintiff treated four months and missed a few days from work. A pre-trial offer of $12,000.00 was made which was rejected by plaintiff.

The Result: Jury verdict in favor of plaintiff in amount of $100,000.00.

• 35-year-old male was a passenger in a vehicle that collided with another vehicle injuring his back. Plaintiff sued both drivers. No offer was made before trial and a minimal offer of $2,500.00 was made by one defendant during trial.

The Result: Jury verdict in favor of plaintiff against both defendants in amount of $100,000.00.

• 44-year-old male with limited tort insurance involved in an intersectional accident with defendant. Plaintiff sustained injuries including low back injury with nerve damage and fluid in his ankle. Defendant argued plaintiff was at fault and that his injuries were not serious. No offer was ever made to plaintiff.

The Result: Jury verdict in favor of plaintiff for $80,463.80.

• 34-year-old male was standing along side a parked vehicle when he was side swiped by defendant's vehicle. Plaintiff sued the driver of the vehicle because of neck, back and shoulders injuries. No offer was ever made to plaintiff in the case. Defendant argued plaintiff was responsible for accident.

The Result: Jury verdict in favor of plaintiff against defendant in the amount of $75,000.00.

Products Liability

• 46-year-old married male was working in a warehouse when the forks of a forklift struck him. Plaintiff's counsel was able to establish the brakes failed because of the negligent maintenance of the forklift. Plaintiff sustained serious injuries that included an aggravation of a left hip condition that required surgery, and lower back disc herniations.

The Result: Case settled for $400,000.00.

Premises Liability/Slip & Fall

• 38-year-old female had to jump from the 3rd floor of a burning building to the sidewalk. Plaintiff's counsel was able to establish that the fire was caused by faulty wiring caused by improper maintenance. Injuries included fractures of her back, hip and thigh and a permanent disability. There was no offer made before trial and an offer of $250,000.00 was made at beginning of trial.

The Result: Jury verdict for plaintiff in amount of $6,600,000.00.

• 42-year-old female fell from steps on side of defendant's house because of a defective handrail causing multiple disc herniations in her neck and back and partial tear in her shoulder. No offer before trial and $20,000 offer made at beginning of trial. Defendant argued that plaintiff could not prove the steps were defective.

The Result: Jury verdict for plaintiff in amount of $175,000.00.

• 79-year-old female was legally on defendant's business premises when automatic doors were caused to swing open due to negligent maintenance injuring plaintiff. Plaintiff sustained significant injuries including a broken hip.

The Result: Case settled for $115,000.00.

• 44-year-old female was a patron of defendant's business when she slipped and fell on a wet floor. As a result, plaintiff sustained injuries including a tear in her knee and shoulder as well as neck and back injuries. At settlement conference, Judge recommended settlement range of $75,000 to $100,000.00.

The Result: plaintiff obtained $105,000.00 settlement.

• 61-year-old male slipped and fell on icy steps leading up to the building that he rented from defendant. As a result of the fall, plaintiff sustained a collarbone fracture and a herniated disc. Defendant argued that the plaintiff knew of the condition of the steps before the accident and should have avoided the ice. No offer made.

The Result: Jury verdict in favor of plaintiff for $80,500.00.

• Plaintiff, a 45-year-old postal worker, was out delivering mail when she slipped and fell on a customer's property due to snow and ice negligently allowed to remain on the property. Because of this fall, plaintiff sustained a broken ankle that required surgery and forced her to miss two months from work. Defendant challenged liability arguing that plaintiff could not prove that the walkway was negligently maintained.

The Result: Case settled for $75,000.00.
