34-year-old male was standing along side a parked vehicle when he was side swiped by defendant’s vehicle. Plaintiff sued the driver of the vehicle because of neck, back and shoulders injuries. No offer was ever made to plaintiff in the case. Defendant argued plaintiff was responsible for accident.
