Can I File a Claim If I Was Hit by a Car While Working in Philadelphia, PA?
Yes. If you were hit by a car while working in Philadelphia, you may qualify for workers’ compensation benefits and may also have a claim against the driver. These are separate claims and can cover different losses. Which applies depends on the circumstances.
As soon as you can, report the injury to your employer. Pennsylvania has deadlines for giving notice of a workplace injury. Reporting promptly can help establish when and how you were hurt.
For the first 90 days of treatment, your employer may require you to see a doctor from an approved list. This applies when the employer meets the state’s notice requirements. Knowing these rules can help you avoid problems getting your medical care covered.
Separate from workers’ compensation, a claim against the responsible driver may cover losses your workplace benefits do not. Workers’ compensation pays certain medical and wage benefits. It does not cover every kind of harm.
Beyond your medical bills, you may recover compensation for pain and suffering and wages not covered by workers’ compensation. Future care expenses may also be part of the claim if you require ongoing treatment. Your injuries and their effect on your work matter.
Under Pennsylvania law, you usually have two years to file a personal injury lawsuit against the driver. Workers’ compensation has different rules and deadlines. Keep track of both filing periods.
When both workers’ compensation and a claim against the driver are involved, a personal injury lawyer in Philadelphia can help determine how the two claims affect each other. An attorney can also address repayment issues so each claim is handled in the right order.
