What Compensation Can Families Recover After a Fatal Crash in Philadelphia, PA?
After a fatal crash in Philadelphia, families may recover compensation for lost financial support, household services, companionship, guidance, and reasonable medical and funeral expenses. However, families can only recover these damages if another party is found legally responsible for the death.
Under Pennsylvania law, wrongful death compensation generally goes to the surviving spouse, children, and parents. Although these relatives benefit from the claim, the deceased person’s personal representative ordinarily files the lawsuit on their behalf, following the required legal process.
Beyond a wrongful death claim, the estate may also pursue a survival claim for losses the deceased person experienced before death. These may include conscious pain and suffering and lost earnings, but the same losses cannot be recovered twice.
To support your family’s claim, keep income records, medical bills, funeral receipts, and information about your loved one’s household contributions and role in the family. These records can help show the financial and personal losses your family has experienced. If available, employment records and prior tax returns may also help establish lost financial support.
In Pennsylvania, families generally have two years from the date of death to file a wrongful death lawsuit. However, some exceptions may affect this deadline. Filing too late could prevent the case from moving forward.
As the claim moves forward, a Philadelphia wrongful death lawyer can identify the losses your family may be able to recover. An attorney can also gather supporting records and handle negotiations with insurance companies.
