How Are Firefighters Covered After an On-Duty Injury in Mantua, NJ?
Firefighters hurt while on duty in New Jersey are generally covered through the state’s workers’ compensation system rather than a typical personal injury claim. Workers’ compensation can provide medical treatment, a portion of lost wages, and benefits for permanent impairment, regardless of who was at fault for the injury. This no-fault structure means a firefighter does not need to prove negligence to receive these benefits.
New Jersey law also includes specific protections for firefighters and other public safety workers, since the risks of the job differ significantly from most occupations. Benefits can cover injuries from heat exposure, smoke inhalation, structural collapse, and falls, among other on-duty hazards. The process for filing a claim typically involves prompt reporting to a supervisor and a medical evaluation, since delays in reporting can sometimes complicate a claim.
In limited situations, a firefighter may also have a claim against a party outside the employer, such as a property owner or another entity whose negligence contributed to the hazardous conditions at the scene. These third-party claims are separate from workers’ compensation and depend heavily on the specific facts involved.
A personal injury lawyer can help evaluate whether a third-party claim may exist alongside a workers’ compensation claim and can assist with navigating the paperwork and deadlines that apply to each.
