Which Injuries Are Common in Pedestrian Crashes in Philadelphia, PA?
Pedestrian crashes in Philadelphia can cause head injuries, broken bones, spinal injuries, internal injuries, and deep cuts or road rash. Some injuries are minor, while others can require extensive treatment and a long recovery.
Even if you’re able to walk away, some injuries, like a concussion or internal bleeding, may not show clear signs right away. Seeing a doctor soon can detect hidden injuries and show when your treatment began.
Under Pennsylvania law, your own auto insurance, or the policy of a relative you live with, may pay your early medical bills through first-party benefits, even though you were on foot. If no household policy applies, the driver’s policy may cover those benefits instead.
Depending on the extent of your injuries, a claim against the driver may include lost income, medical costs beyond first-party benefits, and pain and suffering. If you need long-term care, your claim may also cover the cost of future treatment.
To show how the crash happened, you should gather photos of the scene, the police report, witness contact information, and any nearby security or doorbell camera footage. Some video may be erased within days, so it’s best to ask for it early.
In most cases, you have two years from the date of the crash to file a personal injury lawsuit in Pennsylvania. Missing this deadline can keep you from seeking compensation in court, even if your claim is strong.
If the driver’s insurer questions your injuries or delays payment, a Philadelphia pedestrian accident lawyer can gather your medical records and other proof needed to support your claim. An attorney can also handle communication with the insurance companies so you can focus on your recovery.
