Wrongful Death Claims After Fatal Truck and Vehicle Accidents in East Norriton, PA
Losing a family member suddenly leaves behind more than grief; it commonly means unpaid medical bills from final treatment, funeral costs that arrive almost immediately, and the loss of whatever income or support that person provided.
In these situations, Pennsylvania law addresses this through two related but distinct legal actions. First, a wrongful death claim which allows a spouse, children, or parents to recover for their own losses, including funeral and burial expenses and the loss of the deceased’s companionship and financial support.
Separately, a survival action that allows the deceased’s estate to recover for what the deceased personally experienced before death, such as pain, suffering, and medical expenses, with any recovery becoming part of the estate rather than going directly to family members.
When more than one vehicle or driver contributed to a fatal outcome, Pennsylvania’s modified comparative negligence rule becomes especially relevant. Under this rule, recovery is only barred if the deceased is found 51% or more at fault, with any award otherwise reduced by that percentage.
When fault has to be sorted out between multiple parties, a wrongful death lawyer can become crucial. A lawyer can lead an investigation and coordinate with accident reconstruction specialists to make sure evidence is preserved and explain to families how it can be used to build a potential claim.
