Can Families Recover Compensation After a Fatal Hit-and-Run in Philadelphia, PA?
Yes, your family may be able to recover compensation after a fatal hit-and-run in Philadelphia, even if the driver is never found. Uninsured motorist coverage on your loved one’s policy or a household member’s policy could help. Pennsylvania drivers may reject this coverage in writing, so the policy must be checked.
To help identify the driver, investigators may look for nearby video, witness statements, and vehicle parts left at the scene. The police report may also contain useful information. Families can save any details they receive and ask nearby businesses to preserve security footage before recordings are erased.
Once the driver is identified, the family may be able to bring a wrongful death claim and a separate claim for losses the person suffered before death. The estate’s representative generally handles those filings. The evidence will affect what can be recovered.
Under Pennsylvania law, families generally have two years from the date of death to file a wrongful death lawsuit. Insurance policies may set different notice deadlines, so keeping track of dates matters. Waiting too long can limit the family’s choices.
Because evidence can become harder to find over time, a Philadelphia wrongful death lawyer can gather police updates, surveillance video, and witness details. An attorney can also look into whether the driver can be found and explain what those findings mean for your family’s claim.
